Categories of Trade marks

The national mark or just the trade mark, which distinguishes the goods or services of a natural or a legal person from the respective goods or services of another. The statement can be filed by one or more depositors. The trade mark is granted by the Hellenic Industrial Property Organisation (O.B.I.), in accordance with the Law 4679/2020, it is regulated by this legal instrument, and it takes effect within the Greek territory.

The collective mark, which is determined as a collective one already from its filing, is capable of distinguishing the goods or services of the member of the entity which constitutes the proprietor of the mark from the respective goods or services of other enterprises.

An application for collective mark may only be submitted by collaborations and organizations of manufacturers, producers, service providers or merchandisers who have the capacity to be subjects of rights and obligations in their own name, to enter into or carry out other legal acts and to sue and be sued, as well as legal entities under public law.

The certification mark, which is identified as such already from its filing, is capable of distinguishing the goods or services that are certified by the trade mark’s proprietor, in respect of the material, the mode of manufacture of goods or provision of services, the quality, accuracy or other characteristics, with the exception of geographical origin, from goods and services which are not so certified.

An application for a certification mark may be submitted by any natural or legal person, including organizations, authorities and bodies governed by public law, provided that such person does not carry on a business involving the supply of goods or services of the kind certified.
